1. Introduction

Welcome to LightUrbanSpace ("Company," "we," or "our"). These Terms & Conditions ("Terms") are a contract between you and our company regarding the use of our yacht booking services and our website found at lighturbanspace.site ("the Website") offered by LightUrbanSpace.

By reserving a yacht or by using the Website, you accept these Terms. If you do not agree with any section of these terms, you should not use the Website or our services.

2. Service Overview

LightUrbanSpace offers premier yacht rental services that include but are not limited to:

• Yacht rentals for the day
• Evening boat tours
• Company outings
• Exclusive gatherings
• Extended excursions on the yacht

Availability of services is contingent on many factors including weather conditions. We reserve the ability to change or cease services without prior notification.

3. Booking and Reservations

3.1 Booking Process

For a successful yacht reservation, you need to:

• Be 18 years old or above
• Provide valid and complete details
• Submit the specified advance payment detailed in your reservation confirmation
• Accept these Terms & Conditions

3.2 Confirmation

Reservation is confirmed only after payment is made and you've received our confirmation in writing. We have the authority to deny service to any individual, at our sole discretion.

3.3 Availability

All yacht bookings are contingent on the availability of vessels and favorable weather conditions. We will endeavor to meet your desired dates and times as closely as possible.

4. Payment Terms

4.1 Pricing

All costs are quoted in € and are inclusive of relevant taxes, unless stated otherwise. Prices are subject to change without prior notice.

4.2 Payment Schedule

• Deposit: 50% of the entire charter fee to be paid at the time of booking
• Balance: Due 48 hours ahead of the charter departure
• Incidental expenditures (if any): Payable after the charter ends

4.3 Payment Methods

We accept most major credit cards, electronic fund transfers, and certified bank drafts. Our payment processing is done using secured and encrypted systems.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• If cancelled more than 72 hours before departure: Full refund less transaction charges
• 24-72 hours before departure: Refund of 50% of the charter cost
• Less than 24 hours before departure: No refund will be issued

5.2 Weather Cancellations

Should the weather be deemed unsafe by our captain, we propose two options:

• Reschedule the charter to another available slot at no extra cost
• Offer a complete refund if rescheduling cannot be accommodated

5.3 Mechanical Issues

In case your scheduled vessel encounters mechanical issues, we will attempt to arrange an appropriate substitute. If we are unable to do so, a full refund will be issued.

6. Safety and Conduct

6.1 Safety Requirements

All guests must:

• Obey all instructions provided by the crew
• Use provided safety equipment as stipulated
• Disclose any medical issues that could affect their safety
• Stay within designated areas on the vessel

6.2 Prohibited Articles

The following items are forbidden on the vessel:

• Glass containers
• Illegal drugs
• Weapons or guns
• Excessive amounts of beverages beyond what is considered moderate consumption
• Animals (except if permission is granted beforehand)

6.3 Behavior

Passengers are expected to behave respectfully. Those not complying with this standard may have their charter terminated prematurely without a refund, especially if their actions pose a safety hazard or disrupt others' experiences.

7. Liability and Insurance

7.1 Our Liability

We limit our liability to what you have paid for the yacht charter. We do not take responsibility for:

• Injuries sustained due to passenger irresponsibility
• Theft or harm to personal belongings
• Any indirect, supplementary, or punitive claims
• Delays instigated by weather or unforeseen situations outside our control

7.2 Insurance Coverage

Our comprehensive marine insurance policy safeguards our boats and operations. However, clients should have personal and travel insurance in place.

7.3 Risk Acknowledgment

Your participation in our boating service indicates an understanding that such activities encompass inherent dangers, and you therefore assume the responsibility for your personal safety and security.

8. Modifications and Itinerary Changes

We maintain the right to adjust plans, such as itineraries, paths, and schedules in response to weather factors, safety criteria or practical needs. We will strive to provide an alternative that is similar in quality and experience.

9. Force Majeure

We cannot be held accountable for disturbances, cancellations, or changes resulting from external conditions beyond our control, including but not limited to:

• Extreme weather phenomena
• Natural catastrophes
• Regulatory decrees
• Harbour closures
• Mechanical malfunctions

10. Privacy and Data Protection

Your personal data is managed in alignment with our Privacy Policy. By engaging with our services, you are giving consent to the gathering and utilisation of your information as outlined in the Privacy Policy.

11. Intellectual Property

The content on our Webpage, including but not limited to, text, illustrations, logos, and photographs, is the property of LightUrbanSpace and is protected by copyright and trademark restrictions. Unauthorized reproduction, distribution, or modification is forbidden without our consent in writing.

12. Governing Law

The preceding Terms are regulated by the laws in force in Germany. Any legal proceedings must be conducted in the courts with jurisdiction in Hamburg, Germany.

13. Changes to Terms

We hold the right to modify these Terms when necessary. Amendments will be displayed on our Webpage along with a new revision date. Continued patronage of our services infers an agreement to the amended Terms.
